OVERVIEW

This website and store is operated by Terrasian Global Limited ("PetSoul", "we", "us", "our"), RM 5003, 5/F, Yau Lee Centre, 45 Hoi Yuen Road, Kwun Tong, Hong Kong. Throughout the site, the terms "you" and "your" refer to the user or customer. By visiting our site and/or purchasing from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms"). Please read them carefully. If you do not agree to all the Terms, you may not access the website or use any Service.

1. ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). A breach of any of the Terms will result in immediate termination of your Service.

2. GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks; credit card information is always encrypted during transfer. You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without express written permission from us.

3. ELIGIBILITY & USE

Our products are for personal use only and may not be resold or used commercially without our written permission. We may refuse or limit any order, and may limit or cancel quantities purchased per person, per household, or per order, at our discretion.

4. ACCURACY OF BILLING & ACCOUNT INFORMATION

You agree to provide current, complete, and accurate purchase and account information for all purchases. You agree to promptly update your account and other information, including your email address and payment details, so we can complete your transactions and contact you as needed. We may refuse or cancel any order if fraud or an unauthorized/illegal transaction is suspected.

5. PRODUCTS & PRICING

Products are made to order. Colors and details may appear differently on your screen than in the finished print due to monitor and display variations; this is not a defect. Prices are shown exclusive of applicable taxes, which are calculated and added at checkout based on your shipping address. Prices and product availability are subject to change without notice. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time without prior notice.

6. ORDERS & ACCURACY

You are responsible for providing accurate order details, including the pet photo, personalization options, and shipping address. Where your product includes a proof, you have 3 days (72 hours) to approve or request changes after we send each proof; if we do not hear from you within that window, the proof is deemed approved and we proceed to keep your order on schedule (memorial pieces are exempt and never auto-approved). 7. YOUR UPLOADED PHOTOS — OWNERSHIP & LICENSE

You keep full ownership and copyright of any photo you upload to us. By submitting a photo, you confirm that you own it or have permission to use it and that it does not infringe anyone's rights. You grant PetSoul a limited, non-exclusive, royalty-free license to use and adapt your uploaded photo solely to create and fulfill your order and to provide customer support. We will not use your original uploaded photo for marketing, advertising, or public display without your explicit permission (opt-in). You may withdraw that permission, or ask us to remove your uploaded photo from any such use, at any time by emailing support@petsoulstudio.com.

8. INTELLECTUAL PROPERTY OF OUR ARTWORK

The finished illustration and artwork that PetSoul creates for your order — together with all designs, illustrations, text, graphics, and other site content — are the intellectual property of PetSoul and protected by copyright. PetSoul owns and retains all rights in the artwork it creates and may use, reproduce, and display these finished illustrations (for example, in our marketing, website, and social media) without further permission. As a courtesy, if you'd prefer that we not feature your finished piece in our marketing, just let us know at support@petsoulstudio.com and we'll honor your request. Your purchase grants you the right to personal use and enjoyment of your piece; it does not transfer copyright in the artwork or grant resale, reproduction, or commercial-use rights.

9. CUSTOM-PRODUCT NATURE

Because items are personalized and made to order, they are final sale except as set out in our Refund & Return Policy. Each piece is an artistic, hand-illustrated interpretation of your photo; slight stylization and variations in color, framing, and finish are part of the art and are not defects.

10. SMS / EMAIL MARKETING

If you opt in to SMS or email marketing, you consent to receive recurring automated marketing messages. Consent is not a condition of purchase. Message and data rates may apply. You can opt out at any time (reply STOP for SMS, or use the unsubscribe link in any email). For help, reply HELP or contact support@petsoulstudio.com.

11. PROHIBITED USES

In addition to other prohibitions set out in the Terms, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, or local regulations, rules, or laws; (d) to infringe upon our or others' intellectual property rights; (e) to harass, abuse, defame, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any malicious code; (h) to collect or track others' personal information; (i) to spam, phish, or scrape; or (j) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any prohibited uses.

12. THIRD-PARTY LINKS & TOOLS

Certain content, products, and services available via our Service may include materials from third parties, and we may provide access to third-party tools and links. We are not responsible for examining or evaluating, and we do not warrant, the content or accuracy of third-party materials or websites. Your use of third-party tools or links is at your own risk and may be subject to the third party's terms.

13. DISCLAIMER & LIMITATION OF LIABILITY

We do not guarantee that your use of our Service will be uninterrupted, timely, secure, or error-free. The Service and all products are provided "as is" and "as available" without warranties of any kind, either express or implied. To the maximum extent permitted by law, PetSoul, its directors, officers, employees, and agents shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of any products or the Service.

14. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless PetSoul and Terrasian Global Limited and our affiliates, partners, and employees from any claim or demand, including reasonable legal fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

15. TERMINATION

These Terms are effective unless and until terminated by either you or us. You may terminate them at any time by notifying us that you no longer wish to use our Service, or by ceasing to use our site. If in our sole judgment you fail to comply with any term, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

16. SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision shall be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be severed without affecting the validity and enforceability of the remaining provisions.

17. ENTIRE AGREEMENT

These Terms, together with any policies or operating rules posted on this site (including our Refund & Return Policy, Shipping Policy, and Privacy Policy), constitute the entire agreement between you and us and govern your use of the Service, superseding any prior agreements.

18. CHANGES TO TERMS

We reserve the right to update, change, or replace any part of these Terms by posting updates to our website. It is your responsibility to check this page periodically. Your continued use of the website after changes are posted constitutes acceptance of those changes.

19. GOVERNING LAW

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the jurisdiction of the competent courts of the United States.
